Terms & conditions

These terms and conditions form part of the package travel contract between you (the traveller) and Trimowa UG (haftungsbeschränkt), trading as Ceylonreise (the tour operator), where validly agreed. They supplement the statutory provisions on package travel contracts in §§ 651a–y of the German Civil Code (BGB). Land arrangements only – international flights are never included. 1. ServicesWe organise tours of Sri Lanka as small group tours on fixed dates or as private tours tailored to you. The services included are those described in the tour description on our website or in our individual proposal, and in your booking confirmation. International flights are not part of our tours (land arrangements only) unless expressly agreed otherwise in the booking confirmation. If you book flights yourself, you enter into a separate contract with the airline or an agent.
2. Booking and contractAfter your enquiry you receive a non-binding proposal. By booking – by email or another written form – you make a binding offer to conclude the travel contract. The contract is concluded when we confirm your booking. At or immediately after conclusion of the contract you receive the booking confirmation on a durable medium together with the standard information form required by law. If you book for other travellers, you are responsible for their contractual obligations as for your own, provided you have expressly agreed to this. There is no statutory right of withdrawal (cooling-off period) for package travel contracts concluded by email, phone or via our website (§ 312g(2) no. 9 BGB). However, you may cancel at any time before departure in accordance with section 5.
3. Payment, currency and financial protectionAfter conclusion of the contract and receipt of the insolvency protection certificate (Sicherungsschein), a deposit of 20% of the tour price is due. The balance is due 30 days before departure, provided the tour will go ahead and can no longer be cancelled for the reasons given in section 7. For bookings made less than 30 days before departure, the full price is due immediately. Our prices are calculated in euros. Prices shown in pounds sterling or US dollars are converted at a regularly updated exchange rate. The binding price is the one stated in your booking confirmation; you can pay in the currency shown there. Any bank or card charges for international payments are borne by you. The money you pay us is protected against our insolvency. The certificate naming the insurer that protects your payments is sent to you together with the booking confirmation. If you do not pay the deposit or the balance on time despite a reminder with a deadline, we may cancel the contract and charge cancellation fees in accordance with section 5.
4. Changes to services and pricesChanges to individual services after conclusion of the contract (for example an equivalent hotel in the same place or a different order of stops) that are not made in bad faith are permitted if they are minor and do not affect the overall character of the tour. We will inform you without delay. We may increase the tour price up to 20 days before departure if, after conclusion of the contract, transport costs (in particular fuel), taxes and fees (such as entrance or national park fees) or the exchange rates applicable to the tour change. The increase corresponds to the additional cost per person. If it exceeds 8% of the tour price, you may accept the change or cancel the contract free of charge. If these costs decrease, we refund the corresponding amount.
5. Cancellation by youYou may cancel the contract at any time before departure. Please notify us in writing (e.g. by email). If you cancel or do not start the tour, we lose our claim to the tour price and may instead charge reasonable compensation. It amounts per person to: – up to 60 days before departure: 20% of the tour price – 59 to 30 days before departure: 40% – 29 to 15 days before departure: 60% – 14 to 7 days before departure: 80% – from 6 days before departure or in the event of no-show: 90% You are free to prove that we incurred no loss or a significantly lower loss. No compensation is due if unavoidable and extraordinary circumstances occur at the destination or in its immediate vicinity that significantly affect the tour. We strongly recommend taking out travel insurance that covers cancellation and medical costs abroad.
6. Changes to your booking and transferIf you would like to change your booking after conclusion of the contract (e.g. dates, route, hotels), we will do our best to accommodate you. Up to 60 days before departure we charge an administration fee of €50 per person plus any additional costs charged by our suppliers; after that, a change is only possible by cancellation (section 5) and a new booking. You may transfer your booking to another person up to seven days before departure (§ 651e BGB). You and the replacement traveller are jointly liable for any additional costs.
7. Minimum number of participants for small group toursOur small group tours require a minimum of 4 participants unless stated otherwise in the tour description. If this number is not reached, we may cancel the contract no later than 30 days before departure. You will then receive a full refund without delay, and within 14 days at the latest. We will be happy to offer you another date or a private tour instead.
8. Termination for conductWe may terminate the contract without notice if a traveller persistently disrupts the tour despite a warning, or behaves in such breach of contract that immediate termination is justified. In this case we retain the right to the tour price, less any expenses saved.
9. Problems during your tourIf something is not as agreed during your tour, please tell your tour leader or driver-guide or our team in Kandy (+94 77 212 1155, also on WhatsApp) immediately so that we can put it right. If you culpably fail to report a problem, your claims for a price reduction or compensation may be limited (§ 651o BGB). If you wish to terminate the contract because of a significant defect, you must first give us a reasonable period to remedy it, unless a remedy is impossible or is refused.
10. LiabilityOur contractual liability for damage that is not bodily injury and was not caused culpably is limited to three times the tour price. Further claims under international conventions remain unaffected. We are not liable for services that we merely arrange as third-party services and that are expressly identified as such in the tour description and booking confirmation (for example excursions by other providers booked locally); the terms of the respective provider apply.
11. Passport, visa and health requirementsTo enter Sri Lanka, citizens of the UK, the USA and most other countries need a passport valid for at least six months on arrival and an electronic travel authorisation (ETA). We inform you about the general requirements before booking and about any changes before departure. You are responsible for obtaining your travel documents and complying with the requirements, unless we culpably failed to inform you or informed you incorrectly. Please also follow the advice of your government (e.g. the UK Foreign, Commonwealth & Development Office or the US Department of State).
12. Limitation periodYour claims for defects in the tour (§ 651i(3) BGB) become time-barred after two years, starting on the day the tour was due to end under the contract.
13. Dispute resolution and applicable lawWe do not take part in dispute resolution proceedings before a consumer arbitration board. The contract is governed by German law. For travellers whose habitual residence is in another country, this applies only insofar as it does not deprive them of the protection of mandatory provisions of the law of their country of residence.
